I have
done an order for all three judges to sign since they say they are all
going to recuse. Judge Peschel has signed, I am waiting on the other
two. Once I get that signed I can then fill out the paperwork to
request a judge be appointed to this case by Judge Schraub. Once he
appoints someone I can then tell you what dates would be available to set
your hearing.
So, we
are now waiting for all signatures and an appointment. Once a judge
is appointed I will let all parties know who the judge is. It
shouldn't be to long.

This is to confirm our conversation today
on the phone:
- You were going to look into what visiting
judge would hear the Avery vs.. Tavie Murphy et al case no 06-2079-CV
and "Plaintiff's Motion for Default Judgment against Seguin ISD and
Contempt & Sanctions against Attorneys Lopez and Santos" filed
1/11/07. I will further need the following as I understand it:
- Name of the judge;
- Possible times for the hearing;
- I will need to contact the attorneys for
the Defendants to get their agreement on a time to give you;
- If I don't get agreement, to let you know
for the court to decide the time;
- Once time is determined I am to send a
"Notice of Setting" for the Hearing on Plaintiff's Motion to all
Defendants counsel along with an order for Court
Signature.
Please let me know if I have omitted
something according to the local rules.
